Terms and Conditions
For photography, audiovisual production and creative services.
1. Scope
These terms apply to all contracts between Patrick Art and its clients. They cover photography, video, creative production, art direction, workshops and content creation.
2. Formation of the contract
A contract is considered valid once a quote has been accepted in writing. Confirmation by email, WhatsApp or online form is also accepted.
3. Services
The services performed correspond to the accepted quote. Any modification during the project is invoiced separately. Technical and creative decisions remain with Patrick Art unless otherwise agreed in writing.
4. Pricing and payment
Prices are quoted in euros, plus VAT where applicable. Payment is due within the period indicated on the invoice. For larger projects, an upfront deposit may be requested. Travel expenses, equipment rental, models, locations and other additional costs are invoiced separately.
5. Cancellation and rescheduling
Cancellations must be communicated in writing. No fee applies for cancellations made more than seven days before the service. Cancellations made less than seven days in advance are charged at 50 percent. Cancellations on the day of the production are charged at 100 percent. Changes due to weather conditions are possible by mutual agreement.
6. Copyright and usage rights
Patrick Art is the sole author of all works created. Usage rights as agreed are transferred to the client upon full payment. Unless otherwise specified, simple usage rights are granted for the agreed purpose, such as advertising, social media, web or print material.
6.1 RAW files and original assets
The client is not entitled to receive RAW files, unedited videos, original audio or any raw material. There is no right of possession, ownership or access to these files. RAW files are used exclusively for internal editing and remain the property of the author. The final selection and editing is at the sole discretion of Patrick Art.
7. Credit
Credit must be given to the author in all publications, particularly in press, social media and editorial projects. The recommended credit is “Patrick Art”.
8. Liability
Patrick Art is only liable for damages caused by wilful misconduct or gross negligence. No liability is assumed for force majeure, technical failures, weather or unforeseen circumstances. No liability is assumed for damage to the client’s property except in cases of wilful misconduct or gross negligence.
9. Selection and editing
The selection of images and the editing style follow the artistic vision of Patrick Art. Additional retouching requests may incur extra costs.
10. Delivery
Delivery is made via download link, Dropbox or similar solutions. The usual delivery time is between one and fourteen days, depending on the size of the project. Express delivery is available at an additional cost.
11. Data protection
Personal data is treated confidentially and in accordance with the GDPR and the Spanish LOPDGDD. It is not shared with third parties unless necessary for the delivery of the service.
12. Changes to the project
Changes beyond the original scope of the quote are invoiced separately.
13. Workshops
Workshops and trainings follow the same payment and cancellation conditions. Participants are required to follow all safety guidelines. No liability is assumed for accidents, except in cases of gross negligence.
14. Severability
If any clause is invalid, the remaining clauses remain in force. The invalid clause will be replaced by one that best reflects the original economic intent.
15. Jurisdiction and applicable law
Spanish law applies. The place of jurisdiction is Palma de Mallorca.
